The Wait For Justice Appears to be Over: Devin Nunes Notifies Attorney General He’s Prepared Eight Criminal Referrals For His Consideration

EXCLUSIVE: Republican Rep. Devin Nunes sent a criminal-referral notification to Attorney General William Barr on Thursday alleging several “potential violations” of the law.

Rep. Nunes (R-CA) sent the notification to Barr via letter:

Nunes did not provide any further insight into the indictments than he had already provided during a Sunday morning interview with Fox News’ Maria Bartiromo.

On Sunday Nunes told Bartiromo:

“We’re prepared this week to notify the attorney general that we’re prepared to send those referrals over.  First of all, all of these are classified or sensitive. … Five of them are what I would call straight up referrals — so just referrals that name someone and name the specific crimes.  Those crimes are lying to Congress, misleading Congress, leaking classified information. So five of them are those types.”

“There are three [referrals] that I think are more complicated. …

So on the first one, is FISA abuse and other matters. We believe there was a conspiracy to lie to the FISA court, mislead the FISA court by numerous individuals that all need to be investigated and looked at that, and we believe the [relevant] statute is the conspiracy statute.

The second conspiracy one is involving manipulation of intelligence that also could ensnarl many Americans.”

This refers to what Nunes believes is evidence of  conspiracy to weaponize the intelligence apparatus against a political party and presidential candidate, Donald Trump.

“The third is what I would call a global leak referral.  So there are about a dozen highly sensitive classified information leaks that were given to only a few reporters over the last two-and-a-half-plus years. So you know, we don’t know if there’s actually been any leak investigations that have been opened, but we do believe that we’ve got pretty good information and a pretty good idea of who could be behind these leaks.”

This would refer to the findings of the Inspector General.

Nunes warned those who might be counting heads; the eight criminal referrals could involve more than eight people, and that a conspiracy referral could involve “a dozen, two dozen people.”  He added that additional referrals should be expected.

Between the criminal referrals and the apparent determination by AG Barr  to uncover any wrongdoing, there’s finally reason for optimism.

Two days ago Attorney General Barr was asked about potentially fraudulent submissions to the FISA court in order to secure a Title-One surveillance warrant against U.S. Person Carter Page.

AG Barr’s answer appeared to be well-considered:

The Office of the Inspector General has a pending investigation of the FISA process in the Russia investigation. I expect that will be complete in probably May or June, I am told.  More generally, I am reviewing the conduct of the investigation and trying to get my arms around all the aspects of the counterintelligence investigation that was conducted during the summer of 2016.”
