On Tuesday, Judicial Watch announced that it had gone to court seeking the release of “communications between former FBI General Counsel James Baker and Michael Sussmann, a Perkins Coie law partner and former DOJ attorney.”

(Washington, DC) – Judicial Watch announced today it filed a Freedom of Information Act (FOIA) lawsuit against the Justice Department for communications between former FBI General Counsel James Baker and Michael Sussmann, a Perkins Coie law partner and former DOJ attorney. While at Perkins Coie, Sussman represented the Democratic National Committee (DNC) and Hillary Clinton’s campaign during the time Perkins Coie secretly paid for the development of the anti-Trump dossier the DOJ used to obtain FISA warrants to spy on the Trump campaign.
The lawsuit was filed after the FBI failed to respond to a FOIA request dated October 5, 2018 (Judicial Watch v. U.S. Department of Justice (No. 1:19-cv-00573)). The lawsuit seeks:
- Any and all records of communication between former FBI General Counsel James Baker and former Department of Justice attorney and current Perkins Coie Partner Michael Sussman.
- Any and all records created in preparation for, during, and/or pursuant to any meeting between Mr. Baker and Mr. Sussman.
- Any and all calendars, agendas, or similar records, either in paper or electronic format, documenting the schedule and activities of Mr. Baker.
The time frame for this request is between January 1, 2016 and December 31, 2016.
Judicial Watch filed the lawsuit after the FBI failed to respond to a FOIA request dated October 5, 2018.
Baker had admitted during his closed-door testimony to Congress, that Michael Sussman, a lawyer for Perkins Coie, had given him information alleging that a Russian bank had been communicating with a server in Trump Tower.
That allegation was later proven to be false.
Jeff Carlson, writing at the Epoch Times explains the significance of this:
Perkins Coie partner Michael Sussmann, whose firm had been retained by the Democratic National Committee (DNC) and Hillary Clinton’s 2016 presidential campaign, provided information to Baker and at least one journalist ahead of the FBI’s application for a FISA warrant to spy on Trump campaign foreign policy adviser, Carter Page.
Perkins Coie also was the law firm that had hired Fusion GPS—on behalf of the DNC and the Clinton campaign—which in turn hired former British MI6 agent Christopher Steele to produce the dossier that has become known as the Steele dossier.
Perkins Coie was acting as the cutout to funnel unproven allegations from the Clinton campaign and the DNC into the FBI to essentially purchase surveillance warrants on the Trump campaign. Clinton campaign/DNC to Sussman to Baker. How convenient.
The earliest report on this illegal arrangement came from Sundance at the Conservative Treehouse – on October 4, 2018 – the day before Judicial Watch filed its original FOIA request with the FBI:
After initially stating that a DNC lawyer was a source of information to the FBI for use in their counterintelligence operations against the Trump campaign, the name of the lawyer from the DNC law firm of Perkins Coie has now been revealed as Michael Sussmann.
According to Catherine Herridge reporting testimony from former FBI legal counsel James Baker revealed that Michael Susmann, representing the Clinton team, was feeding information to the FBI for use against the trump campaign.
Judicial Watch was Johnny-on-the-Spot, filing its FOIA request the next day.
Really, it was just a small group of sycophantic Clinton wrongdoers at the FBI. Really…
