The Constitution for Dummies (and, Anti-Trump Leftists): Obama’s Handling of DACA Left Constitution in Tatters – Trump Had No Other Choice

Elder Patriot – The mainstream media has reached a new low with their reporting of Donald Trump’s “uncaring” handling of DACA.  They either, know better and are lying, or they’re totally unqualified to be reporting on anything of importance.

Obama’s Executive Order establishing DACA was an unconstitutional usurpation of the legislative branches authority.  Respected George Washington University Law School Professor Jonathan Turley’s testified before the House Judiciary Committee about DACA’s illegal origins:

“In ordering this blanket exception, President Obama was nullifying part of a law that he simply disagreed with … If a president can claim sweeping discretion to suspend key federal laws, the entire legislative process becomes little more than a pretense … The circumvention of the legislative process not only undermines the authority of this branch but destabilizes the tripartite system as a whole.”

Obama himself had acknowledged this before he signed it.

While the chart below does not accurately depict the depth of the relationship between the different branches of government in does describe which branch of government makes the laws and which enforces the laws.

When Sean Hannity pressed Paul Ryan on what he was going to do about Obama’s dictatorial grabs of legislative priorities the feckless Ryan had this to say:

Armed with this knowledge what was President Trump to do?  Doing nothing meant following in Obama’s footsteps and continuing to enforce an unconstitutional decree even after the Supreme Court had rendered a determination that it was unconstitutional.

If he was the cold-hearted beast that the MSM and Mexican propagandists have smeared him as he simply could’ve put an immediate end to the law, rounded up violators, and deported them.  He chose not to.

Instead he offered Congress a two-year window in which to create a protective blanket for the current DACA designates before they forced his hand on deportations.  This approach allows him to restore the rule of law to his relationship with Congress and not be in contempt of the Constitution.

If Congress can’t get its act together that’s on them but it’s not the president’s job to enforce illegally written laws.  In fact, it’s the president’s job not to. 

If Trump hadn’t given Congress the time to decide the fate of DACA he would’ve been compelled to end it immediately and enforce the existing deportation laws that Congress passed while he was still building golf courses.

The uncaring dictator isn’t Trump but it may very well have been Obama who ignored the pleas of Americans who lost their college placements and their jobs to his DACA people.

Obama took the same oath of office as every president before him and Donald Trump did after as demanded by the Constitution:

US Constitution, Article II, Section 1

Before he enter on the execution of his office, he shall take the following oath or affirmation: “I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States.”

This was a marvelous teaching moment to reaffirm to the American people how the Constitution works and the brilliance of its balance.  Instead the MSM and their D.C. establishment cohorts are trashing the one man showing both fidelity to the Constitution and compassion to those who were seduced by Obama’s lie.
